Your Medicare Hospitalization Rights


As a Medicare beneficiary, you have the following rights:

  1. To receive a document called “An Important Message from Medicare” when you are admitted to the hospital. This document explains your Medicare rights in a hospital setting.


  2. To receive all hospital care necessary for the proper diagnosis and treatment of your illness or injury. According to federal law, your discharge date must be determined by your medical needs, not by the payment the hospital or other health care professional receives for your care.


  3. To be fully informed about decisions affecting your Medicare coverage and payment for your hospital stay and any post hospital services.


  4. To receive a notice of discharge within two days of being discharged from the hospital. This notice gives you your discharge appeal rights (you think you are being discharged too soon) and the number to call to request an appeal.


  5. To file a beneficiary complaint with the QIO concerning the quality of care you received.


SDFMC, a physician organization, serves as the Quality Improvement Organization (QIO) for Medicare in South Dakota. SDFMC has worked to improve the quality of care received by Medicare beneficiaries since 1973. Call our toll-free Medicare information line at (800) 658-2285 or call 1-800-MEDICARe for help and assistance if:

  1. You receive a written “Notice of Discharge” from the hospital and you disagree with the decision to discharge you.


  2. You receive a "Notice of Provider Non-Coverage" from a skilled nursing facility (Nursing Home, Home Health Agency, Hospital Swing bed, Hospice) and you disagree with the decision to discharge you.


  3. You are concerned about the quality of care you received.
